II Setting Your Trademark / Examination on identical or similar trademarks
Whether the trademark applied for being published or refused depends on whether it is identical with or similar to the trademark of another person who enjoys priory in respect of the same or similar goods, where it is identical with or similar to the trademark of another person which, in respect of the same or similar goods, has been registered or, after examination, preliminary approved, the Trademark Office shall refuse the application and shall not publish (the said trademark).

1.Identicalness of verbal trademark means that in the same language, the verbal elements, pronunciation and meaning of the trademarks are the same, the figures forming the trademark have no difference in view or the difference is minute. Trademarks with identical pronunciation and similar form and different but meaningless verbal elements which are easily mistaken by consumers are usually decided as similar trademarks.

2.If the verbal elements of the trademarks using the same language are same in meaning and refer to the same object, but are different in pronunciation and form, and there is great difference in overall structure, they will not be decided as similar trademarks usually. If other words are added before or after the verbal elements of a trademark and meaning changed and there does exist the referred objects, it will not be decided as a similar trademark.

III An application must include the following elements about China Trademark Registration
1.Application form of registration;
2.Qualification certificate of applicant;
3.A clear drawing of the mark;
4.A listing of the goods or services;( For one class you can specify 10 goods or service. More than 10, more fee.)
5.The filing fee for at least one class of goods or services.

VI China Trademark Application procedures
----Submit to the Trademark Office of China the application material, in three month, the Office gives us an Acception Acknowledgement (after doing some formal examination). Then the Office will do preliminary examination, after the preliminary examination, if there is no problem, the Office will publish a preliminary examination proclamatory on the Trademark Gazette. Time from acception to publishing cannot be specified. After publishing the preliminary examination gazette, there is 3 months for the public to check and raise opposition. If in the 3 months, no oppostion raised, the Trademark Office will publish a registration proclamatory on the Trademark Gazette. One and a half months after that you will get the Trademark Registration Certificate.

----Time above-mentioned amounts to 2 year approximately, if the preliminary examination does not pass and re-examination needed or the public files opposition, the time will be longer.

----The following is the summary: Submit material -> Formal Examination -> Acception Acknowledgement ->Preliminary Examination -> Gazette Publishing -> Time for Public Examination->Registration Proclamatory -> Certificate

⑧other matters concerning the determination of the attribution of the trademark right and the review and adjudication of trademarks prescribed by laws and regulations.
